1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Minted Habits mobile application (the “App”) operated by Everly Digital (“Everly Digital,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms.
If you do not agree, do not use the App.
2. About the App
Minted Habits is an iOS habit-tracking application designed to help you build habits with a calmer, low-pressure experience. The App may allow you to create habits, track completion, view progress, and write notes.
We may update or change features over time. Some features may require a paid subscription.
3. Eligibility and Accounts (Including Minors)
The App is rated 4+. If you are under the age of majority where you live, you must have your parent or legal guardian’s permission to use the App, and your parent or legal guardian is responsible for your activity in the App.
By using the App, you represent that:
- You are permitted to use the App under applicable laws and the App Store terms; and
- If you are a minor, your parent/guardian has reviewed and agreed to these Terms on your behalf.
4. Account Registration and Security
Some features require creating an account. You agree to:
- Provide accurate information when creating your account;
- Maintain the confidentiality of your login credentials; and
- Notify us immediately if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account.
5. Subscriptions, Billing, and Cancellations (RevenueCat / Apple)
Certain features may be offered through paid subscriptions (“Subscriptions”). Subscriptions for Minted Habits are processed through Apple In-App Purchases and may be managed using RevenueCat.
Billing and renewal
- Subscription fees (if any) are billed through your Apple ID account.
- Unless you cancel, your subscription may auto-renew at the end of each billing period, subject to Apple’s policies.
How to cancel
You can cancel your subscription through your Apple ID subscription settings. Cancelling stops future charges but does not automatically refund amounts already paid.
Refunds
Refund requests are handled by Apple in accordance with Apple’s refund policies. We do not control Apple’s refund decisions.
Price changes
Apple may require your consent to certain price changes. We may also update pricing from time to time as allowed by Apple’s rules.
6. Your Content (Habits, Notes, and Other Inputs)
The App may allow you to create and store content such as habit names, completion logs, and notes (“User Content”). You retain ownership of your User Content.
By using the App, you grant Everly Digital a limited, non-exclusive, worldwide license to host, store, process, and display your User Content only as necessary to operate and improve the App and provide services to you.
You are responsible for your User Content and agree not to submit content that:
- Is unlawful, harmful, or infringing;
- Contains malware or attempts to disrupt the App; or
- Violates the rights of others.
7. Acceptable Use
You agree not to:
- Use the App for unlawful purposes;
- Attempt to reverse engineer, decompile, or exploit the App;
- Interfere with or disrupt the App or its systems;
- Access the App using automated means in a way that harms performance;
- Bypass security or access controls; or
- Use the App to harass, abuse, or harm others.
We may suspend or terminate access if we believe you have violated these Terms.
8. Privacy and Data Handling
We care about privacy and aim to handle data responsibly.
High-level summary (until a standalone Privacy Policy is published):
- We collect and process data necessary to operate the App (e.g., account information and app usage).
- We do not sell your personal information.
- We do not use your User Content to train machine learning models.
- We recommend that you review Apple’s privacy disclosures for the App as presented in the App Store. We may publish a standalone Privacy Policy page in the future; when we do, it will be incorporated by reference into these Terms.

9. Third-Party Services
The App may rely on third-party services such as Apple (App Store, In-App Purchases) and RevenueCat (subscription management). Your use of those services may be governed by their terms and policies. We are not responsible for third-party services or platforms.
10. Intellectual Property
The App, including its design, text, graphics, trademarks, and software, is owned by Everly Digital or its licensors and is protected by intellectual property laws.
You receive a limited, non-transferable, non-exclusive license to use the App for personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App unless permitted by law or with our written permission.
11. Disclaimers (Not Medical Advice)
Minted Habits is provided for informational and self-improvement purposes only.
- The App does not provide medical, psychological, or professional health advice.
- Do not rely on the App as a substitute for professional advice, diagnosis, or treatment. If you have concerns about your health or well-being, consult a qualified professional.
The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Everly Digital and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising out of or related to your use of the App.
In any event, our total liability for claims arising out of or relating to the App will not exceed the amount you paid to us (if any) for the App in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Everly Digital from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your use of the App; your User Content; or your violation of these Terms or applicable law.
14. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms or if we need to do so for security, legal, or operational reasons. Termination does not affect rights or obligations that by their nature should survive termination.
15. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, through the App or via an updated “Last updated” date). Continued use of the App after changes become effective means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of laws principles. You agree that courts located in Ontario will have jurisdiction over disputes arising out of or relating to these Terms, unless applicable law provides otherwise.
